Real estate legal disputes encompass a wide range of issues, including ownership conflicts, the enforcement of owners’ rights and obligations, property transfers, leases and rental agreements, land divisions, buying and selling transactions, and other matters related to real estate. These disputes may be pursued through civil or criminal proceedings and often arise from financial disagreements, contract-related claims, or issues concerning property rights and owners’ responsibilities.

Real Estate Disputes: Three Main Categories—Registration, Criminal, and Civil

Real estate disputes can be classified into three primary categories: registration, criminal, and civil.

A) Registration Disputes:
These involve conflicts related to the registration or transfer of ownership and property titles. Examples include unauthorized ownership transfers, establishing ownership rights, and the rejection or cancellation of property registrations.

B) Criminal Disputes:
These arise from unlawful actions such as theft, destruction, or various forms of contract violations. Key examples include breach of trust, illegal sale of property belonging to another, forgery of property documents, and the use of forged documents in transactions.

C) Civil Disputes:
The most significant civil disputes include cases like unlawful possession, the obligation to draft official deeds, issues related to rental agreements and tenant rights, contract annulment and termination, as well as the eviction of commercial and residential properties. In these disputes, once the rights and obligations are clarified and a final court ruling is obtained, the resolution of property conflicts is carried out accordingly.
